New York District Judge Lewis A. Kaplan rejected SBF's attempt to subpoena Silicon Valley law firm Fenwick & West as part of its criminal defense, court documents show. SBF is trying to compel U.S. prosecutors to turn over documents the firm provided to the government, and failing that, seeks to subpoena the firm by court order to produce the same documents. Judge Lewis A. Kaplan denied SBF's motion, saying neither the firm nor the FTX debtors were part of the "prosecuting team," and that the government "has no obligation to produce material that is not in its possession, custody, or control," and that "defendants' proposed subpoena If enforced, it would be a speculative act that does not meet the requirements of specificity, relevance, and admissibility set forth in United States v. Nixon."
