Bitcoin miner Greenidge Generation has filed a lawsuit against the New York State Department of Environmental Protection (DEC) over its decision to deny a Category 5 air permit for its Dresden power plant.
The DEC denied the application in June 2022, citing Greenidge’s failure to comply with the Climate Leadership and Community Protection Act. Although Greenidge’s appeal was denied in May 2024, the company was granted a four-month grace period, allowing it to continue operating under its existing permit until September 8.
Greenidge argues that the DEC’s decision was “arbitrary and capricious” and interferes with the New York Public Service Commission’s jurisdiction over power generation facilities, disregarding the procedures of the New York Independent System Operator.
The company further argues that the regulator’s position to shut down the facility was based on its involvement in cryptocurrency mining, even though the facility also provides electricity to the grid. Greenidge also highlighted the facility’s contributions to the state’s economy, including jobs and tax revenue.
If the DEC’s decision is not reversed, Greenidge says it will be forced to shut down the facility by September 9. (CryptoSlate)
