TRUMP Terms and Conditions of Sale Include Class Action Waiver

The foregoing clause is an essential foundation of this Agreement. ” The Class Action Waiver clause reads: “To the extent permitted by law, you agree not to commence, join or participate in any class action proceeding with respect to any claim, dispute or controversy you may have against any Insured Party. You consent to injunctive relief to stop such action or to disqualify you as a participant in such action. You agree to pay the attorneys’ fees and litigation costs incurred by any Insured Party in seeking such relief. This clause preventing you from filing, joining or participating in a class action: (i) does not constitute a waiver of any right or remedy you may have to bring a claim individually and not as a class in binding arbitration as set forth above; and (ii) is an independent agreement. You may opt out of these dispute resolution provisions by giving written notice of your decision within thirty (30) days of your first visit to the Site.”
