Former FTX CEO Sam Bankman-Fried (SBF) declined to testify remotely in the Voyager Digital bankruptcy case, Bloomberg reported. SBF's attorney, Marc R. Lewis, had asked the court on Tuesday to deny the summons from attorneys for Voyager's unsecured creditors. The attorney argued that the subpoena should be dismissed because it was not properly served, is unreasonable, and may require the FTX CEO to invoke his Fifth Amendment constitutional rights to avoid incriminating himself. The subpoena, which previously ordered SBF to appear in person at McDermott Will & Emery's San Francisco office on Feb. 23 to answer questions, included 49 separate and wide-ranging document requests to be filed by Feb. 20.
