Hinman email: Hinman had ignored multiple warnings and had planned to call Vitalik to confirm his position that ETH cannot be considered a security

Ripple Chief Legal Officer Stuart Alderoty tweeted that according to the Hinman email released by the US Securities and Exchange Commission in the Ripple case, William Hinman, the former SEC Finance Director, ignored multiple warnings that his speech contained fictitious analysis without legal basis, out of The Howey factor is exposed, and regulatory loopholes are exposed, which will not only cause confusion, but also cause even greater confusion in the market. While Hinman claimed the speech was his personal opinion, he and the SEC touted it as guidance. Hinman also believed there was no need to regulate ETH as a security, and had planned to call Vitalik Buterin to confirm his position.
