Odaily Planet Daily News NFT artist Danny Casale (also known as Coolman Coffeedan) won a multi-million dollar profit sharing contract dispute with Web3 art curator DigiArt.
It is reported that Casale signed with DigiArt in May 2021, and the company helped him gain exposure in exchange for half of his NFT sales, as well as the exclusive "right to market and sell all NFTs created by Casale" until May 2022 The contract expires on the 2nd.
However, after Casale launched an NFT project called “Coolman’s Universe” on its own on December 21, 2021, DigiArt sued Casale in March 2023 for alleged breach of contract.
DigiArt alleges that Casale "completely neglected his contractual obligations" when launching the project, but does not list any specific financial damages in the complaint. The company also admitted that it did not attempt to enforce the relevant agreements until several months after the project was launched.
Additionally, DigiArt failed to provide a written start date in its contract with Casale, among other important details.
This ultimately led U.S. District Court Judge Wendy Berger of the Middle District of Florida to rule in Casale's favor, dismissing the case.
According to data from OpenSea, the series includes 10,000 cartoon avatar NFTs, with total sales reaching 26,400 ETH ($42 million), and the floor price is tentatively reported at 0.05 ETH. (ArtNet)
