Elon Musk withdrew his lawsuit against OpenAI and its co-founders Sam Altman and Greg Brockman in California state court on Tuesday. Just a day earlier, Musk had publicly criticized OpenAI and its new partnership with Apple.
Court documents show that the case has been unconditionally withdrawn. A hearing is scheduled for Wednesday in San Francisco, where the judge will consider whether the case should be dismissed as requested by the defendants.
Musk filed a lawsuit in San Francisco Superior Court on the evening of February 29, local time, represented by Los Angeles law firm Irell & Manella, suing OpenAI and its CEO Altman for breach of contract.
Musk said in the lawsuit that Altman and OpenAI violated an agreement reached when the AI research company was founded to develop technology for the benefit of humanity rather than profit. Musk claimed that OpenAI's recent relationship with tech giant Microsoft undermined the company's original goal of working on public, open-source general artificial intelligence (AGI).
Court documents show that Musk has made allegations against OpenAI, including breach of contract, breach of fiduciary duty, and unfair business practices, and asked the company to resume open source. Musk also asked the court for an injunction barring OpenAI, its president Greg Brockman, Altman (a co-defendant in the case), and Microsoft from profiting from the company’s artificial general intelligence technology.
