Philip Brimmer, a judge in the United States District Court for the District of Colorado, ruled to dismiss a class action lawsuit against Atomic Wallet, an Estonian cryptocurrency wallet provider. The court found that it lacked jurisdiction over Atomic Wallet, its CEO Konstantin Gladyshev, shareholder Pavel Sokolov, and the affiliated software development company Evercode Infinite. The lawsuit stems from the hack of Atomic Wallet in June 2023 for approximately $100 million. In his ruling, Judge Brimmer pointed out that the connection between Atomic Wallet and Colorado is not sufficient to constitute the court's jurisdiction over the company. The judge specifically emphasized that given that Atomic Wallet provides software application services, it is difficult for the company to determine the specific geographic location of users. The court gave the plaintiffs an additional 21 days to provide reasons why the lawsuit against Ilia Brusov, one of the founders of Evercode Infinite and a 12.8% stake in Atomic Wallet, should not be dismissed.
