Senior U.S. District Judge Phyllis J. Hamilton granted a request by Ripple CEO Brad Garlinghouse and the SEC to seal certain court documents. The parties can now keep sensitive information confidential as the case progresses.
The sealed documents include key exhibits related to summary judgment and expert testimony that are critical to the case. The court entered its decision based on the Ninth Circuit’s “compelling cause” rule.
Ripple sought to seal eight exhibits related to summary judgment and 56 exhibits in opposition to the SEC’s motion. At the same time, the SEC requested that some of its exhibits, including expert testimony, be sealed.
