According to Foresight News, the DeFi Education Fund, along with 115 crypto builders, investors, and advocates, has submitted a joint letter to the Senate Banking and Agriculture Committees. The letter calls for protections for software developers and non-custodial service providers in market structure legislation, emphasizing that without such protections, they cannot support any related market structure bills.
The letter highlights the need for U.S. digital asset legislation to recognize and protect the historical rights of open-source software development. It stresses that developers and non-custodial service providers should not be subjected to traditional financial intermediary regulations simply for creating, developing, releasing, and maintaining blockchain networks or providing user access interfaces where users manage their own funds. The aim is to prevent non-intermediary activities from being wrongly classified as money transmission businesses.
The letter also notes that regulatory uncertainty has led to a decline in the proportion of open-source software developers in the U.S., dropping from 25% in 2021 to 18% in 2025.
