Texas-based apparel company Beba and crypto lobbying group DeFi Education Fund have voluntarily withdrawn their 2024 lawsuit against the U.S. Securities and Exchange Commission (SEC) concerning airdrops. The lawsuit alleged that the SEC violated the Administrative Procedure Act by regulating digital asset airdrops through enforcement without following formal rule-making procedures. The withdrawal document states that the progress of the SEC's Crypto Task Force and multiple public statements by Commissioner Hester Peirce indicate a potential shift in regulatory attitudes towards airdrops, including consideration of an airdrop exemption framework and a "safe harbor" mechanism. DeFi Education Fund stated that continuing the litigation is unnecessary under the current circumstances.
