Lawyers for Sam Bankman-Fried (SBF) suggested installing surveillance software on SBF’s phone to automatically record and archive his communications, CoinDesk reported. U.S. District Court Judge Lewis Kaplan requested at Thursday's hearing to see a written list of former and current employees SBF could contact, expressing concerns about SBF's ability to encrypt his information or otherwise evade surveillance under the agreement's current terms. Foresight News previously reported that U.S. District Court Judge Lewis Kaplan modified SBF’s bail conditions, barring SBF from contacting former and current FTX and Alameda Research employees and from using Signal or other casual messaging apps. Afterwards, SBF’s legal team and prosecutors reached an agreement to amend SBF’s bail conditions for electronic communications, allowing SBF to use various messaging apps, but SBF will not be allowed to use encrypted messaging apps, such as Signal, during bail.
