案件情况大家都知道了，一年前案例刚出来的时候，我曾经写过一篇文章，分析为什么不应当认定为非法经营罪，又一起！买卖虚拟数字货币等于买卖外汇？我没想到这个案件能被广东高院作为案例宣发，更没想到最高法的相关公号也在转发。
是不是外汇，应当由权威机关予以认定，我国有国家外汇管理局，本案属地也有国家外汇管理局梅州市支局，这在我之前的文章中提过的，难道一个县级基层院的法官就能“首创”认定虚拟数字货币属于外汇？这起案件的判决难道不是负面案例吗？
好！既然法官虚拟数字货币是外汇，卖币的陈某，保镖李某都被判了刑，请问拿着现金去买币的人呢？他就不是买卖外汇吗？这才是本案最大的BUG。
案例的作用之一，是给人们生活以指引。通过这个案例，我们不难得出结论，卖币不行，买币没事！请问是这样吗？
