These documents show the U.S. Department of Trade and Markets’ comments on Hinman’s 2018 speech draft. Unredacted portions of Ripple’s briefing against the SEC’s motion for summary judgment show senior SEC officials saying the fewer details about Hinman’s speech, the better. Brett Redfearn, director of trade and markets at the time, issued an unedited statement that the speech "could lead to greater confusion about what a security is, as Hinman's new test goes beyond the typical Howey analysis." The Hinman Speech Document refers to a speech given by William Hinman (2017-2020), former Director of Finance at the U.S. Securities and Exchange Commission (SEC) at the Yahoo Finance Marketwide Summit in June 2018, in which he stated that Ethereum is not a security, Ripple viewed the speech as key evidence in its ongoing legal battle with the U.S. Securities and Exchange Commission, which has accused Ripple of violating U.S. securities laws with its XRP sales.
